Taylor MacLellan Cochrane has been developing expertise in these exciting areas of law all of which have very important application in Nova Scotia and throughout Atlantic Canada. Fishing, agriculture, forestry and mining have historically been key economic generators in Nova Scotia in particular and are part of the rich socio-cultural fabric of our Province.


Jeff Silver is a Partner at Taylor MacLellan Ccchrane who has developed a significant corporate commercial practice in the fishery. He is fully and thoroughly conversant with the law and policy regime governing the purchase and sale of fishing licenses, core enterprises and fishing vessels. Jeff also has a tax law practice and works very closely with major accounting firms in the province to ensuing that individual and corporate fishing clients have the best advice available in this complex area of law.


Andrew Montgomery has a background originally in earth sciences and for a number of years managed soil survey projects both in Ontario and Nova Scotia in support of the agricultural industries in those provinces. He spent a significant amount of time in Nova Scotia while in the employ of the Department of Agriculture working on agricultural land use policies and agricultural land development objectives.


Andrew also has significant experience in the area of maritime, admiralty and fisheries law, particularly as these areas of law relate to such matters as vessel arrest, access to particular fisheries, quota allocation, fisheries management agreements, partnership agreements, trust agreements, and the purchase and sale of fishing enterprises.

What We Do

  • Represent individual fish harvesters appealing licensing decisions before Regional Licensing Appeal Committees and the Atlantic Fisheries License Appeal Board;
  • Draft fisheries management agreements for selected fisheries under co-management;
  • Advocating on behalf of fish harvester’s and fish harvesters’ organizations for improved access and allocation in the fishery;
  • Purchase and sale of fishing licenses and fishing vessels;
  • Preparation of trust agreements relating to financing of fishing licenses;
  • Incorporation of fishing companies and preparation of shareholders’ agreements and annual fishing plans;
  • Preparation of fisheries partnership agreements;
  • Arbitration and litigation of fisheries partnership disputes;
  • Judicial review of decisions of the Minister of Fisheries and Oceans;
  • Defence of charges under the Fisheries Act, the Species at Risk Act, the Wildlife Act, the Wilderness Area Protection Act, the Canada Shipping Act;
  • Right to farm issues including resource conflict concerns and integrated resource management;
  • Legal advice regarding resource development, land use and environmental planning, contaminated sites.
