University Law

TMC LAW has been providing legal services to one of Canada's leading secondary educational institutions, Acadia University, for over 35 years. Acadia University has been consistently ahead of most other undergraduate Canadian universities in the annual MacLean's magazine survey of universities in Canada. Acadia University is located in Wolfville, Nova Scotia, and has an annual enrolment of over 3500 students, who come from around the world to attend the university.

As with any business, the University requires a broad range of legal services in its own unique setting including general advice, preparation and drafting of contracts, work regarding property acquisition and disposition, document and statutory interpretation and financing and trust issues. In addition to these services, TMC LAW provides a comprehensive range of litigation support for a wide range of legal issues.

The unique nature of a university community with its constituent parts -- governance, academics, other staff and students require that legal services recognize this unique composition and the special interests that arise from that uniqueness.

LeRoy Lenethen, Q.C. has been involved as the lead solicitor for Acadia University's legal needs since the mid 1970's following the appointment of the University's former solicitor, J.A. (BAS) MacLellan (also of Taylor MacLellan & Cochrane) to the Provincial Court Bench. LeRoy is a founding member of the Canadian Association of the University Solicitors (1979) and has served that national organization as a member of its executive and as president and has been a presenter on a number of occasions at its annual meetings. This unique body brings together the lawyers from across Canada who do legal work for universities and colleges and allows for a free flowing exchange of ideas, trends and expertise in University Law.

Chris Thomson has been working with LeRoy on university issues since he first joined TMC LAW in 1993. He brings his emphasis in corporate/commercial and tax matters to bear on university legal issues and has, for a number of years, been extensively involved with trademark issues (registration, opposition proceedings, licensing, etc.) on behalf of the University. In addition, he has provided advice to the University through the implementation and follow up of the Acadia Advantage program and the Y2K issues that was at one time a prominent topic with individuals and corporations. Chris has been particularly involved with special financing projects, major contract negotiations and contract drafting with the University's Growth & Operations Division and significant work regarding Endowment funding and other fundraising issues through the University Development Office.

Having the opportunity to do legal work for Acadia University over a continuous period of over 35 years has provided TMC LAW with the opportunity to bring history and consistency to bear on the provision of legal advice to the University.
